Terms of service

These Terms of Service govern your use of Can I Park Here?, operated by Avi Flombaum. By using the service, you agree to these Terms. If you do not agree, do not use it.

The service

Can I Park Here? provides informational parking-rule checks, map views, conversational explanations, and suggested driving routes. It is a convenience tool, not a reservation system, navigation system, legal service, or guarantee of a parking space.

Parking information is limited

Results are based on available NYC parking-sign and related public records and may be incomplete, inaccurate, outdated, delayed, or affected by temporary conditions. A route or “clear” result does not mean a space exists, that parking is legal at the time you arrive, or that the route is safe or optimal. Posted signs, curb markings, official notices, temporary restrictions, and your own judgment control. Always check the street and comply with applicable law.

Acceptable use

You may use the service only for lawful, personal purposes. Do not interfere with the service, attempt to bypass rate limits or security controls, scrape it at scale, probe or attack its infrastructure, upload malicious code, impersonate another person, or use generated output to endanger people or property.

Third-party services

The service relies on third-party providers for hosting, maps, directions, AI responses, analytics, and support. Their availability, content, and policies are outside our control. Your use of those parts of the service may also be subject to their terms.

Your content and feedback

You are responsible for the text and feedback you submit. Do not include passwords, financial information, or other sensitive personal information. You give us permission to process submitted content as needed to provide, secure, analyze, and improve the service. You retain rights you already have in your content.

Intellectual property

The service, its software, design, branding, and original content are owned by Avi Flombaum or our licensors and are protected by applicable law. These Terms give you a limited, revocable, non-exclusive right to use the service for its intended purpose.

Disclaimers

To the maximum extent allowed by law, the service is provided “as is” and “as available,” without warranties of any kind, express or implied. We disclaim warranties of accuracy, availability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Limitation of liability

To the maximum extent allowed by law, Avi Flombaum and the service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for parking tickets, towing, fines, loss, injury, property damage, or other harm arising from your use of or reliance on the service. Our total liability for claims relating to the service will not exceed the greater of the amount you paid us for the service in the twelve months before the event giving rise to the claim or 100 U.S. dollars.

Indemnity

To the extent allowed by law, you agree to defend and hold harmless Avi Flombaum from claims, losses, liabilities, and expenses arising from your misuse of the service, violation of these Terms, or violation of another person’s rights.

Changes and termination

We may change, suspend, or discontinue the service or update these Terms at any time. We may restrict access when necessary to protect the service or users. Updated Terms take effect when posted with a new effective date.

Governing law and contact

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Before bringing a claim, please contact parking@avi.nyc so we can try to resolve it.
